1. Introduction
Welcome to CommonDish (we, our, us).
These Terms & Conditions (Terms) govern your access to and use of the CommonDish Platform, including our mobile applications, website, and related services (Services).
By creating an account or using CommonDish, you agree to these Terms and our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Platform.

CommonDish operates a digital marketplace that connects:
Customers ordering prepared food or fresh products;
Vendors (restaurants & local shops) offering such items; and
Delivery Partners provide delivery services.
CommonDish acts as a facilitator, not as a direct seller of goods or an employer of delivery partners.
Company Status:
CommonDish is operating as CommonDish Technovation, a business entity in the process of formal registration in Portugal. All transactions and agreements remain valid and enforceable under Portuguese and EU commercial law. The company registration number and corporate details will be added once the process is complete.
3. Eligibility
You must be at least 16 years old and legally capable of entering into contracts under Portuguese and EU law.
For business accounts, you must have legal authority to represent the entity.
4. User Accounts
You must create an account to place orders or list products.
Provide accurate, current, and complete information.
Keep login credentials confidential. You are responsible for all activity under your account.
We may suspend or close accounts that violate these Terms or applicable law.
5. Services Provided
Through the Platform, users can:
Browse nearby restaurants and local shops;
Place and pay for orders (for delivery, pickup, or dine-in);
Track orders in real time.
Communicate with vendors or delivery partners.
6. Vendor Responsibilities
Vendors agree to:
Provide accurate product descriptions, prices, and availability.
Comply with food safety, hygiene, and labeling laws.
Honor orders accepted through the Platform.
Maintain all necessary business licenses and insurance.
Vendors remain solely responsible for the quality and safety of the food or goods sold.
7. Delivery Partners
Delivery Partners are independent contractors, not employees of CommonDish.
They agree to:
Hold valid driving and insurance documents.
Comply with all transport and labor laws.
Handle deliveries safely and promptly.
CommonDish provides technology to connect Delivery Partners with orders, but is not a transport company.
8. Orders and Payments
Orders are binding once confirmed by the Vendor.
Payments are processed securely through third-party providers (namely: Stripe or PayPal).
Prices include VAT where applicable.
Refunds or cancellations follow the policies of each Vendor, subject to EU consumer rights.
CommonDish may charge service or delivery fees, clearly displayed before checkout.
9. Right of Withdrawal (EU Consumers)
Under the EU Consumer Rights Directive, customers generally have a 14-day withdrawal right.
However, this does not apply to:
Perishable food or goods likely to spoil;
Personalized or custom items;
Services already fully performed (e.g., completed deliveries).
Refunds are handled per applicable law and vendor policy.
10. User Conduct
You agree not to:
Use the Platform for unlawful, fraudulent, or harmful purposes;
Misuse promotional offers or create fake accounts;
Harass or abuse vendors, delivery partners, or staff;
Interfere with the Platform’s security or functionality.
Violation may lead to immediate account termination.
11. Ratings & Reviews
Users may leave honest feedback. Reviews must be respectful, factual, and relevant.
CommonDish may remove content that is defamatory, discriminatory, or misleading.
12. Intellectual Property
All software, designs, trademarks, and content on CommonDish are owned by CommonDish Technovation or its licensors.
You may not copy, modify, distribute, or commercially exploit any part of the Platform without written consent.
13. Data Protection & Privacy
We process personal data in accordance with our Privacy Policy and GDPR requirements.
By using CommonDish, you acknowledge that your data may be shared with vendors, delivery partners, and payment processors strictly for service delivery purposes.
14. Limitation of Liability
To the extent permitted by law:
CommonDish is not liable for the quality, safety, or legality of food or goods sold by vendors.
We are not responsible for delays, errors, or damages caused by third-party vendors or delivery partners.
Our total liability in connection with any claim shall not exceed the total amount you paid for the affected order.
Nothing in these Terms limits liability for death, personal injury, fraud, or any matter which cannot be excluded under EU law.
15. Suspension & Termination
We may suspend or terminate your account if:
You breach these Terms or applicable laws;
Fraudulent or abusive behavior is detected;
Required by regulatory authorities.
You may close your account anytime via your profile settings.
16. Platform Availability
We strive to keep CommonDish available at all times, but do not guarantee uninterrupted or error-free operation.
Scheduled maintenance or updates may cause temporary downtime.
17. Promotions & Campaigns
Any discounts, referral bonuses, or promotions are subject to specific conditions published on the Platform.
CommonDish reserves the right to modify or withdraw promotions without notice.
18. Third-Party Links
Our Platform may contain links to third-party websites.
We do not control or endorse their content and are not responsible for their privacy or security practices.
19. Governing Law & Jurisdiction
These Terms are governed by the laws of Portugal and the European Union.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal, unless EU consumer law provides otherwise.
20. Amendments
We may modify these Terms to reflect updates in services or legal obligations.
Changes will be posted on our website and, where significant, notified by email or in-app message.
Continued use of the Platform after updates constitutes acceptance.
